Terms of Use

Last updated: 2026-08-25

1. General Provisions

1.1. These Terms of Use (hereinafter - the Terms) set out the procedure under which users (hereinafter - the User) use the “Pik-Up” mobile application (hereinafter - the Platform), maintained by the application owner K.A.T. Group SIA, registration No. 40203598613 (hereinafter - the Operator).
1.2. By registering on the Platform, the User confirms that they have read, understood, and agree to these Terms. If the User does not agree to the Terms, use of the Platform is not permitted.
1.3. Definitions used in these Terms:
User - any person who uses the Platform.
Client - a User who orders a service or purchases goods.
Provider/Merchant - a User who provides services or sells goods.
Service - any work, delivery, transport, repair, goods, or other activity requested by a Client and provided by a Provider/Merchant.

2. Status and Liability of the Platform (Intermediary Disclaimer)

2.1. Intermediary role: the Platform provides an intermediary service by offering a digital environment in which Clients may request services or goods and Providers/Merchants may offer and perform them. The Operator’s maximum liability shall not exceed EUR 100.
2.2. Contractual relationship: all contracts for the provision of services (including, for example, transport, repairs, or purchase of goods) are concluded directly between the Client and the Provider/Merchant. The Operator is not a party to such transactions.
2.3. Limitation of liability: the Operator assumes no liability for:
the quality, safety, or legal compliance of services provided by Providers;
the quality of goods or their conformity with descriptions;
any losses or damage arising from direct communication or transactions between Users;
indirect losses, including loss of profit, reputational damage, or similar losses;
continuous or uninterrupted operation of the Platform;
technical failures caused by external factors.
2.4. Employment relationship: Providers and Couriers are not employees of the Operator. They are independent service providers (self-employed persons or companies, independent merchants) who are solely responsible for paying taxes, obtaining licences, and conducting their activities. A Provider acting as a merchant confirms that they are entitled to provide the services and comply with all tax and licensing requirements.

3. Registration, User Account, and Security

3.1. In order to use the full functionality of the Platform:
the User must create an account and authenticate by SMS/email verification code and, where necessary, complete registration;
Providers/Merchants must complete identity verification (KYC) by submitting an identity document and a selfie photo.
3.2. The User undertakes to provide truthful information, not to use the application for unlawful activities or fraud, to communicate respectfully with partners and couriers, not to interfere with the operation of the Platform, and to comply with all applicable laws and regulations.
3.3. Use of a false identity is prohibited.
3.4. The User is responsible for the security and confidentiality of their account access credentials. All actions performed from the account are deemed to have been performed by the User.
3.5. The User is responsible for the security of their device, updates, and antivirus software.
3.6. The User agrees to the processing of data necessary for the operation of the application. Personal data is processed in accordance with the Privacy Policy and the European Union General Data Protection Regulation (GDPR).
3.7. The User has the right to access, correct, delete, restrict the processing of their data, and withdraw consent where such consent has been provided.
3.8. The Company may transfer data to third parties where necessary to provide the service or where required by law.

4. Prohibited Activities and Account Blocking

This section defines the red lines whose breach allows the Operator to immediately delete a user.
The Operator has the right, without prior notice, to apply temporary restrictions, restrict functions, or block (delete) the User’s account in the following cases:
4.1. Fraud and falsification:
making payments with stolen or invalid bank cards;
creating fake profiles or impersonating another person;
posting misleading advertisements.
4.2. Aggressive conduct:
threats, offensive language, or harassment of other Users (in chat or in person);
physical violence during the provision of a service.
4.3. Circumvention of the Platform’s intermediation:
organising direct transactions outside the Platform, including attempts to agree with Clients/Providers on transactions outside the Platform in order to avoid registered activity (where applicable).
4.4. Systematic breaches:
frequent and unjustified cancellation of orders after confirmation;
a low rating (for example, an average rating below 3.5 stars) indicating inadequate service quality.
4.5. Non-payment:
failure by a Provider or Merchant to pay the applicable subscription fee.
4.6. The Operator reserves the right, at its discretion, to restrict or block a User’s account if conduct is identified that may endanger the security or stability of the Platform, the rights of other Users, or the reputation of the Platform, even where the specific situation is not expressly listed in these Terms.
4.7. Blocking or deleting an account does not release the User from the obligation to settle existing liabilities, and subscription fees are non-refundable.

5. Intellectual Property

5.1. Platform rights: all Platform content (code, design, logos, databases), except for User-generated content, is the exclusive property of the Operator and is protected by copyright.
5.2. User content: by uploading content (profile photos, advertisement descriptions, reviews), the User confirms that they have the right to do so.
5.3. Licence: the User grants the Operator a free, non-exclusive licence to use, reproduce, and publish User-generated content for the purposes of operating the Platform (for example, to display goods to other buyers).
5.4. It is prohibited to copy, modify, or distribute Platform content without the Operator’s permission.

6. Payments, Subscriptions, and Cancellation

6.1. Providers/Merchants: the ability to provide services on the Platform is a paid service (subscription). Subscription terms, prices, and cancellation procedures are described in the “Subscription Terms” section. Subscription fees are non-refundable if an account is blocked due to a User’s breach.
6.2. Clients: use of the basic functionality is free of charge. For specific services (rides, goods), the Client pays in accordance with the prices indicated on the Platform. Depending on the scenario and current settings, an order service fee may be added to the amount payable by the Client. The fee may be zero; where it applies, it is shown before payment confirmation.
6.3. Subscription payments are made through an integrated payment system.
6.4. The Company may change the amount of subscription fees by publishing changes on the Platform.
6.5. Cancellation terms:
if a service has been started or completed, no refund is normally made, except where required by applicable law or decided otherwise by the Operator after assessment;
if the Client cancels an already paid order, the paid amount is normally non-refundable, including any order service fee that may have applied;
if the Provider, Merchant, or Operator cancels an order before the service starts, the Operator may refund the order price. Any order service fee that applied remains non-refundable, and a cancellation service fee may be retained from the refundable amount. Depending on the scenario and current settings, either fee may be zero;
the recipient is not entitled to a payout for a cancelled order unless the Operator expressly determines otherwise after assessment. Refund timing depends on the original payment method and payment service provider.

7. Communication Rules

7.1. The Platform chat may be used only for the performance of a service.
7.2. The following are prohibited:
advertising, spam, and promotion of off-platform transactions;
disclosure of third-party data;
profanity, offensive statements, and discrimination.

8. Technical Availability and Force Majeure

8.1. The Platform may be temporarily unavailable for technical reasons. The Operator is not liable for losses caused by technical interruptions.
8.2. The Operator is not liable for delays or losses caused by force majeure circumstances, including war, strikes, natural disasters, or cybersecurity incidents.

9. Dispute Resolution and Applicable Law

9.1. These Terms are governed by the laws of the Republic of Latvia. All disputes between the Operator and the User shall be resolved through negotiations. If no agreement is reached, the dispute shall be submitted to a court of the Republic of Latvia.
9.2. Disputes between a Client and a Provider must be resolved between them. The Platform may, but is not obliged to, act as a mediator to help reach a compromise.

10. Amendments to the Terms

10.1. The Operator may amend the Terms by publishing a new version on the Platform.
10.2. Amendments enter into force upon publication.
10.3. The User is responsible for reviewing the current version of the Terms.
10.4. Continued use of the Platform after publication of amendments is deemed acceptance of the new Terms.
